Any person placing an order through this WEBSITE may access these general terms and conditions of sale. Any contract made through the website will be formalized in the language in which the purchase was made.

1.3 PRODUCT AVAILABILITY

Our product offers on the website are subject to product availability. In case of unavailability of products after the order has been recorded, we undertake to inform you as soon as possible and indicate the new deadline within which you will receive your order. In this case, you will have the option to cancel your order and be reimbursed the amount paid by Paypal, bank transfer within 14 days of the cancellation request, or you can request the change of your order by email (info@ciclolux.com).

3. ORDERING AND SHIPPING

3.1 ORDERS

1. The WEBSITE reserves the right to accept or refuse any order for no apparent reason, undertaking to inform you if such a situation should arise.
2. You are responsible for providing us with accurate information to get the product to you with all the guarantees. In the event that an order cannot be shipped due to the lack or incorrectness of the shipping information provided, the customer will be solely responsible.
3. The WEBSITE is not responsible for orders that do not arrive correctly or are impossible to process.
4. All products purchased from this WEBSITE are for personal and non-transferable use. They may not be resold or loaned to third parties.
5. In no case we will process your order until you have completed the purchase process (in any of its variants) and the payment is recognized as finalized.

3.2 SHIPPING

Orders will be shipped to the address you have requested. At your request, the order will be shipped to:

Your home address
The post office corresponding to your home address
Point of convenience
It is up to you to provide us with all the information necessary for the correct shipment of your package. The transit of the package or the delivery time will depend on the type of shipment contracted and its final destination (you can consult the times of your order). If you have not received your order during this period or you have not been informed of the new delivery time, you can request the cancellation of the order.

The orders of our products are shipped the same day or the day after you make the purchase (weekends and holidays not included). In case you do not receive the order because you have not gone to pick it up, and a new shipment must be made, the shipping costs will be borne by you.

Shipping and delivery times are approximate, in no case will be guaranteed. The WEBSITE will not be responsible for possible delays caused by the transport company or other causes beyond its management and control.

The possibility of sending and supplying the product to the customer will depend on the availability of the same. In case of lack of stock, inability to process orders or other causes, the WEBSITE will inform you and give you the option to wait or cancel your order and refund the money if necessary.

In the event that a delivery requires a signature or similar to confirm receipt of the shipment, it shall be your sole responsibility to ensure that someone is present to receive the shipment at the address provided on the order form. At the same time, it will also be your responsibility to pick up the products from the corresponding transport agency if you are not at the delivery address. In the event that the package is returned, you will be charged again for the transportation costs.

4. WARRANTIES

DRAISLER VENTURES S.L. guarantees that at all times complies with current warranty regulations, highlighting everything included in the Law 1/2007, of November 16, of the Revised Text of the General Law for the Defense of Consumers and Users and the Civil Code, as well as all applicable rules to the case.

If at the time of receiving the order it is defective, you may request the replacement or return of the order under the terms and conditions set forth in the legislation of guarantees of consumer goods and other regulations applicable in your case.

This warranty does not cover possible damages caused by natural causes, misuse, negligence, accident or modification of any part of the product. Neither does it cover damages derived from incorrect maintenance operations, connections to inadequate voltages or repairs made by any person external to DRAISLER VENTURES S.L. In case of return of the product due to breakage or a manufacturing defect, the full amount of the product including shipping costs will be paid.

At this WEBSITE we are confident in the effectiveness of our devices, so we offer a 12-month warranty after your purchase covering possible manufacturing defects or defective materials. If the product is found to be defective, we will fix it or replace it with a new one at no charge to you. After the warranty period has expired, the user must pay for any repairs and parts that need to be repaired or replaced.

4.1. DERECHO AL DESISTIMIENTO

If any product of your order does not correspond to your expectations you may exercise your right of withdrawal within 14 days after you, or a third party authorized by you, receive the package.

Since June 2014, the European Union has established new purchase guarantee parameters by which we are governed. According to these return conditions you have the right to withdraw from your purchase of any product on the WEBSITE within 14 days. This period will end 14 days after the date of receipt of the products. However, if the period ends on a non-business day, the period is extended until the next business day.

We will confirm receipt of your request and refund the amount paid by Paypal, check or bank transfer within 14 calendar days of receipt of your withdrawal request, provided that the product has been previously returned.

The exercise of the right of withdrawal will involve the refund of the price of the returned product and the original shipping costs. You will have to bear the direct cost of returning the products.

For health or hygiene reasons, and based on the applicable regulations, you may not cancel those products that have been unsealed after delivery.

5. RETURNS

The refund methods will depend on the type of exchange you want to make. Depending on your case, you should proceed as follows (For more information see also previous sections)

5.1. DERECHO AL DESISTIMIENTO

To exercise the refund for withdrawal you must follow the following steps:

1. Request the return form within 14 days of receipt of the package.

3. You will have to send the products and once received and verified that everything is correct, we will proceed to refund the money.

The return conditions will only be effective if:

Any product of your order does not correspond to your expectations. You may exercise your right of withdrawal within 14 days of receiving the package.

In addition, you must:

Print the “Money Back” form and include it in the package you will send us.
Include your IBAN and SWIFT number (in case you have not paid by credit card). The transfer is international and without this information we will not be able to make it. If you have any doubts, please consult your bank. The forms without this information will be automatically discarded and the refund will be cancelled.

• You will be refunded 100% of the amount paid for the product (except for shipping costs, which shall be borne by the customer).

For DEVICE WARRANTIES

This warranty does not cover possible damages caused by natural causes, misuse, negligence, accident or modification of any part of the product. To exercise the return under warranty you must follow the following steps:

We will determine the cause of the defect or breakage
If the cause of the failure was not due to any of the causes listed above, we will proceed to repair or replace the device.
If so, the company will pay all repair and shipping costs if necessary.

6. RESPONSIBILITY

The products offered comply with current Spanish legislation.

The WEBSITE shall not be liable for the non-delivery of the order due to force majeure, acts of God, strikes whether of the entity itself, sectoral or general or those promoted by workers of postal and transport services and / or communications. The WEBSITE shall not be liable for the aforementioned facts of indirect damage, benefit or opportunity.

The WEBSITE reminds you that in application of the provisions of the Civil Code, unemancipated minors do not have the capacity to contract. Orders intended for minors must be placed by those exercising parental authority or guardianship. In the event of accidental collection of a minor’s data, parents or guardians may object to its storage and processing.

Hypertext links may redirect you to other websites. The WEBSITE declines all responsibility in the event that their content contravenes the legal and regulatory provisions in force.

7. MODIFICATION OF THE LEGAL CONDITIONS

This WEBSITE reserves the right to adapt or modify at any time the present general conditions of sale. The new general conditions of sale will be accessible by the customer through the website and will be applied only in sales after the modification.

8. DISPUTE RESOLUTION AND JURISDICTION

The provision of the service of this WEBSITE and these conditions of use are governed by Spanish law. Any dispute arising from the services provided through this WEBSITE, will be resolved through the consumer arbitration courts, mediators or the like to which DRAISLER VENTURES S.L. is adhered at the time of the dispute, as well as the corresponding courts and tribunals in accordance with Spanish law.
